Application

1.1 These General Terms and Conditions apply to all products in the webshop of Ventus Sports.

1.2 In addition to these General Terms and Conditions, Supplementary Conditions may apply to certain products if expressly indicated.

1.3 "Buyer" refers to any visitor to the website or any natural or legal person who is or will be in a contractual relationship of any kind with Ventus Sports.

1.4 Ventus Sports reserves the right to modify or supplement these terms and conditions from time to time.

1.5 By using the website of Ventus Sports and/or placing an order, the Buyer accepts these General Terms and Conditions as well as all other rights and obligations stated on the website.

Offers

2.1 All offers made by Ventus Sports are non-binding and subject to product availability. Ventus Sports has the right to deliver a similar product instead of the ordered product or to cancel the agreement.

2.2 An agreement is concluded when an order confirmation is made through the website.

2.3 The Buyer and Ventus Sports expressly agree that the use of electronic communication forms creates a valid agreement. Especially, the absence of a physical signature does not invalidate the offer and its acceptance. The electronic files of Ventus Sports serve as a presumption of evidence to the extent permitted by law.

2.4 Information, images, communications made orally, by phone, or via email, etc., regarding all offers and the main characteristics of the products are presented or made as accurately as possible. However, Ventus Sports does not guarantee that all offers and products fully comply with the given information. Deviations cannot, in principle, be the basis for compensation and/or termination.

Prices

3.1 All prices are expressed in Euros, in accordance with the legal regulations.

3.2 All prices include Dutch VAT but exclude other government taxes and shipping costs, unless otherwise stated in the product information. If the buyer is located outside the country of shipment, the buyer is responsible for any applicable VAT or customs duties.

3.3 Special offers are valid only for the specified period mentioned in the offer.

3.4 Shipping costs within the Netherlands are 8.95 euros. Shipping costs to other countries will be automatically calculated during checkout.

Payment

4.1 Unless expressly agreed otherwise, delivery is made only after advance payment.

4.2 The Buyer shall bear all (extra) judicial costs of any kind incurred by Ventus Sports as a result of the Buyer's failure to fulfill its payment obligations.

4.3 In case of late payment, Ventus Sports is entitled to terminate the agreement immediately or suspend further delivery until the Buyer has fully complied with the payment obligations, including interest and costs due.

Delivery / Delivery time

5.1 Delivery times indicated on the website are indicative and not a strict deadline. Ventus Sports is not liable for damages resulting from exceeding the delivery times.

5.2 If a product that is temporarily out of stock is ordered by the Buyer, the expected availability will be indicated. Delays will be communicated to the Buyer by email or phone.

5.3 Ventus Sports will arrange delivery by mail or any other chosen means. Ownership is transferred upon delivery.

5.4 Ventus Sports is authorized to deliver in parts. The additional costs for backorders will be borne by Ventus Sports.

5.5 Different conditions may apply for deliveries outside the Netherlands.

5.6 Be aware of the fact that 90% of the U-STICK products are custom made. The delivery time for these products may differ depending on the workload. The more orders we have, the longer it will take.

Exchange and Right of Withdrawal

6.1 For agreements concluded through the website or solely through electronic communication, the Buyer has the right to exercise the right of withdrawal without a penalty and without giving reasons within seven working days after delivery of the product in question.

6.2 If the Buyer exercises the right of withdrawal as mentioned in the previous clause, Ventus Sports will arrange a refund within 30 days of the payment received from the Buyer. The cost of returning the product is borne by the Buyer.

6.3 If the buyer bought a product from U-STICK, the return policy may differ. 90% of the U-STICK products are custom made and will not be accepted when returned. We do not hold stock of these products. All bladders are 100% custom made and can not be returned. If the buyer believes that they are entitled to a replacement item, they may get in touch with U-Stick.

Data Processing

Your personal data will only be used for the execution of our services and services and the management of resulting relationships. If you fill in a contact or registration form on the website or send us an email, this data will be kept for as long as necessary for complete answering and handling. We use your address information only to send your items, and we won't bother you further. Your email address will remain known to us in case the manufacturer requires all customers to be informed about an urgent warranty case.

7.1 Security

Through an https/ssl connection, the visitor's data is protected from cybercriminals. Database information is stored in an environment protected by the hosting provider. Versus cannot be held liable for any loss of personal data or damage caused thereby.

Due to the use of third-party software, it is possible that certain personal data may be stored outside Europe.

Force Majeure

8.1 In case of force majeure, Ventus Sports is not obligated to fulfill its obligations towards the Buyer, and the obligation will be suspended for the duration of the force majeure.

8.2 Force majeure is understood to mean any circumstance beyond its control that wholly or partially prevents the fulfillment of obligations towards the Buyer. This includes strikes, fire, business disruptions, power failures, non-delivery or untimely delivery of suppliers or other third parties involved, and the lack of any permit obtained from the authorities. Force majeure also includes disruptions in (telecommunications) networks or connections or the unavailability of the website at any time.

Compensation

9.1 Ventus Sports can only be held liable for damage that can be attributed to its intent or gross negligence, or arises from circumstances for which it is strictly liable under mandatory legal provisions.

9.1 The provisions of this article do not affect the statutory liability of Ventus Sports under mandatory legal provisions.

Applicable Law / Jurisdiction

10.1 Dutch law applies to all legal relationships between Ventus Sports and the buyer.

10.2 All disputes arising from this agreement or subsequent agreements resulting therefrom will be settled in accordance with the Rules of the Dutch Arbitration Institute, or, if Ventus Sports chooses, by the competent court of the domicile or establishment of Ventus Sports or the buyer. The procedure will be conducted in the Dutch language.

10.3 The Dutch text of these general terms and conditions prevails over translations thereof.

Please note that translations may sometimes lose some nuances of the original language, so it's always good to have the original text available for reference.

At Ventus, we take our customers and their privacy seriously. Personal information we receive is treated confidentially and processed in accordance with the General Data Protection Regulation (GDPR).

The maximum retention period of the cookies used through this service is set by us to 26 months.

If you explicitly indicate that you want a newsletter, your email address will be added to our list of subscribers. You will receive a clear update in the mail from time to time (approximately 2/3 times per month). This way, we keep you informed about the latest news, test days, and product updates from Versus. Each newsletter contains a link to unsubscribe. We do not provide the subscriber list of the newsletter to third parties.

A cookie is a simple small file that is sent along with this website and stored by your browser on the hard drive of your computer. We use cookies to remember your settings and preferences. For example, you will stay logged in and your shopping cart will remain filled when you step away from your computer. If you prefer not to, you can also disable these cookies via your browser. The Facebook pixel collects five types of data:

HTTP headers: Everything in HTTP headers. HTTP headers are a standard web protocol sent between a browser request and a server on the internet. HTTP headers contain IP addresses, information about the web browser, page location, document, referrer, and the person using the website.
Pixel-specific data: Including the pixel ID and Facebook cookie.

Order Handling

When placing an order, we use your personal data to handle it properly. We may provide your personal data to our delivery service to have the order delivered to you. We also receive information about your payment from your bank or credit card company.

For this purpose, we use the NAW data, phone number, billing address, email address, payment information, gender, and date of birth. We need this information for the agreement we enter into with you. We will retain this information until your order is completed and for seven years thereafter (as required by law). This data will not be shared with third parties.

Leaving a Review on the Website

It is possible to leave a review for the products we publish on our website. In that case, we ask for your name and email address. After we publish your review, it will be posted at the bottom of the article on our website with your name as the sender. The email address you provide will never be published but will only be requested for verification purposes. We will keep the information you provide to us in this way as long as the article remains online. Om succesvol te zijn, moet je inhoud nuttig zijn voor je lezers.

1. Toepassing

1.1 Deze Algemene Voorwaarden zijn van toepassing op alle producten in de webshop van Versus Kiteboarding.

1.2 Naast deze Algemene Voorwaarden kunnen indien nadrukkelijk aangegeven Aanvullende Voorwaarden van toepassing zijn op bepaalde producten.

1.3 Onder “Koper” wordt verstaan iedere bezoeker van de internetsite dan wel elke natuurlijke persoon of rechtspersoon die met Versus Kiteboarding in een contractuele relatie van welke aard dan ook staat of komt te staan.

1.4 Versus Kiteboarding behoudt zich het recht voor deze voorwaarden van tijd tot tijd te wijzigen of aan te vullen.

1.5 Door het gebruik van de internetsite van Versus Kiteboarding en/of het plaatsen van een bestelling aanvaardt de Koper deze Algemene Voorwaarden alsmede alle andere rechten en plichten zoals die staan vermeld op de internetsite.

2. Aanbiedingen

2.1 Alle aanbiedingen van Versus Kiteboarding zijn vrijblijvend. Aanbiedingen geschieden onder voorbehoud van de beschikbaarheid van de producten. Versus Kiteboarding heeft het recht in plaats van het bestelde product een soortgelijk product te leveren dan wel de overeenkomst te ontbinden.

2.2 Een overeenkomst komt tot stand op het moment dat een orderbevestiging via de internetsite is gedaan.

2.3 Koper en Versus Kiteboarding komen uitdrukkelijk overeen dat door gebruik te maken van elektronische communicatievormen een geldige overeenkomst tot stand komt. Met name ook het ontbreken van een gewone handtekening doet niet af aan de verbindende kracht van het aanbod en de aanvaarding daarvan. De elektronische bestanden van Versus Kiteboarding gelden, voor zover de wet dat toelaat, hierbij als een vermoeden van bewijs.

2.4 Informatie, afbeeldingen, mededelingen mondeling, telefonisch of via email verstrekt en opgaven et cetera met betrekking tot alle aanbiedingen en de belangrijkste kenmerken van de producten worden zo nauwkeurig mogelijk (weer)gegeven of gedaan. Versus Kiteboarding garandeert echter niet dat alle aanbiedingen en producten volledig met de gegeven informatie et cetera in overeenstemming zijn. Afwijkingen kunnen in beginsel geen aanleiding zijn tot schadevergoeding en/of ontbinding.

3. Prijzen

3.1 Alle prijzen zijn uitgedrukt in Euro's, in overeenstemming met de wettelijke voorschriften hieromtrent

3.2 Alle prijzen zijn inclusief Nederlandse omzetbelasting, maar exclusief andere heffingen van overheidswege en exclusief verzendkosten, tenzij anders vermeld in de op het product betrekking hebbende informatie. Indien de afnemer zich niet in het land van de verzending bevindt, is de afnemer aansprakelijk voor de eventueel verschuldigde omzetbelasting of invoerrechten.

3.3 Speciale aanbiedingen zijn slechts geldig voor de geldigheidsduur zoals vermeld bij die aanbieding

3.4 Verzendkosten binnen Nederland bedragen bij bestellingen <50 euro 4.95 euro. Boven de 50 euro verzenden wij gratis binnen Nederland. Verzendkosten naar het buitenland worden automatisch berekent in de check-out.

4. Betaling

4.1 Indien niet uitdrukkelijk anders is overeengekomen geschiedt de levering uitsluitend bij vooruitbetaling.

 4.2 Ten laste van de Koper komen tevens alle (buiten-)gerechtelijke kosten van welke aard dan ook, die Versus Kiteboarding als gevolg van de niet nakoming door Koper van diens (betalings-)verplichtingen heeft moeten maken.

4.3 In geval van niet-tijdige betaling is Versus Kiteboarding bevoegd de overeenkomst met onmiddellijke ingang te ontbinden of (verdere) levering op te schorten tot het moment waarop de Koper de betalingsverplichtingen volledig is nagekomen, de betaling van verschuldigde rente en kosten daaronder begrepen.

5. Aflevering / levertijd

5.1 Op de Internetsite aangegeven levertijden gelden als indicatie en niet als fatale termijn. Versus Kiteboarding is nimmer aansprakelijk voor schade als gevolg van overschrijding van levertijden.

5.2 Indien een product dat tijdelijk niet op voorraad is door de Koper wordt besteld, zal worden aangegeven wanneer het product weer beschikbaar is. Vertragingen zullen aan de Koper per email of telefonisch worden gemeld.

5.3 Versus Kiteboarding zorgt voor bezorging per post of verzending op enige andere wijze ter keuze van Versus Kiteboarding. De eigendom gaat over bij aflevering.

5.4 Versus Kiteboarding is gerechtigd de aflevering in gedeelten na te komen. De extra kosten van de nalevering worden door Versus Kiteboarding gedragen.

5.5 Bij leveringen in het buitenland kunnen afwijkende voorwaarden gelden.

6. Ruilen en herroepingsrecht

6.1 Voor overeenkomsten die via de internetsite tot stand zijn gekomen of op een andere wijze waarbij uitsluitend gebruik is gemaakt van elektronische communicatie, geldt dat de Koper het recht heeft zonder boete en zonder opgaaf van redenen een herroepingsrecht uit te oefenen binnen zeven werkdagen na aflevering van het product in kwestie.

6.2 Indien de Koper van het herroepingsrecht zoals vermeld in het vorige lid gebruik heeft gemaakt, dan draagt Versus Kiteboarding zorg voor terugbetaling binnen 30 dagen van het door de koper aan Versus Kiteboarding betaalde. De kosten voor het terugzenden van het product zijn voor rekening van de Koper.

7. Gegevensverwerking

Je persoonsgegevens worden alleen gebruikt voor het uitvoeren van onze diensten en services en het beheren van de daaruit voortvloeiende relaties. Als je een contact- of aanmeldformulier op de website invult, of ons een e-mail stuurt, dan worden deze gegevens bewaard zolang het nodig is voor de volledige beantwoording en afhandeling daarvan. Je adresgegevens gebruiken we alleen om je spullen op te sturen, verder laten we je met rust. Je e-mailadres blijft bij ons wel bekend voor als de fabrikant verlangt dat alle klanten worden ingelicht wegens een urgent garantiegeval.

7.1 Beveiliging

Middels een https/ssl verbinding zijn de gegevens van de bezoeker beschermd tegen cybercriminelen. Database gegevens worden in een door de hosting provider beschermde omgeving opgeslagen. Versus kan niet aansprakelijk gesteld worden voor eventueel verlies van persoonsgegevens of de schade hierdoor geleden.

Door het gebruik van derde partij software, is het mogelijk dat bepaalde persoonsgegevens buiten Europa opgeslagen worden.

8. Overmacht

8.1 In geval van overmacht is Versus Kiteboarding niet gehouden haar verplichtingen jegens de Koper na te komen, respectievelijk wordt de verplichting opgeschort voor de duur van de overmacht.

8.2 Onder overmacht wordt verstaan elke van haar wil onafhankelijke omstandigheid, waardoor de nakoming van haar verplichtingen jegens de Koper geheel of gedeeltelijk wordt verhinderd. Tot die omstandigheden behoren onder meer stakingen, brand, bedrijfsstoringen, energiestoringen, niet of niet-tijdige levering van toeleveranciers of andere ingeschakelde derden en het ontbreken van enige via overheidswege te verkrijgen vergunning. Tevens wordt onder overmacht verstaan storingen in een (telecommunicatie-)netwerk of verbinding of gebruikte communicatiesystemen en/of het op enig moment niet beschikbaar zijn van de internetsite.

9. Schadevergoeding

9.1 Versus Kiteboarding kan slechts aansprakelijk gehouden worden voor schade, die aan haar opzet of grove schuld is toe te rekenen, dan wel ontstaan is door omstandigheden die op grond van dwingendrechtelijke regels voor haar risico komen.

9.1 Het in dit artikel bepaalde laat onverlet de wettelijke aansprakelijkheid van Versus Kiteboarding ingevolge dwingendrechtelijke bepalingen.

10. Toepasselijk recht/bevoegde rechter

10.1 Op alle rechtsbetrekkingen tussen Versus Kiteboarding en de koper is Nederlands recht van toepassing.

10.2 Alle geschillen welke mochten ontstaan naar aanleiding van de onderhavige overeenkomst dan wel van nadere overeenkomsten, die daarvan het gevolg mochten zijn, zullen worden beslecht overeenkomstig het Reglement van het Nederlands Arbitrage Instituut of, indien Versus Kiteboarding daarvoor kiest, de bevoegde rechter van de woon- of vestigingsplaats van Versus Kiteboarding of de koper. De procedure zal worden gevoerd in de Nederlandse taal.

10.3 De Nederlandse tekst van deze algemene verkoopwaarden prevaleert boven vertalingen daarvan.
